Welcome to NextLegal Services (“Website”). By accessing or using this Website, You agree to comply with and be bound by the following Terms and Conditions (“Terms”). If You do not agree to these Terms, You must discontinue use of the Website immediately.

These Terms constitute an electronic record under the Information Technology Act, 2000 and applicable laws of India.

No Advocate-Client Relationship

3.1Mere access to the Website, submission of inquiries, sending emails, phone calls, WhatsApp messages, uploading documents, booking consultations, or preliminary discussions shall not create any advocate-client relationship between You and the Firm.
3.2An advocate-client relationship shall arise only upon:
  • completion of conflict checks,
  • formal acceptance by the Firm,
  • execution of an engagement arrangement,
  • and/or written confirmation from the Firm.
3.3The Firm reserves the absolute right to decline representation without assigning reasons, including on account of conflicts of interest, professional ethics obligations, or internal policy considerations.

Online Payments and Refunds

10.2The Firm shall not be liable for:
  • payment gateway failures,
  • banking issues,
  • transaction interruptions,
  • or unauthorized payment processing errors beyond reasonable control.
10.3Consultation fees and professional charges once paid shall generally be non-refundable unless otherwise agreed in writing by the Firm.

Document Uploads and Cyber Risk

11.1Users uploading documents through the Website acknowledge the inherent risks associated with internet-based transmission and storage.
11.2The Firm shall not be responsible for unauthorized access, interception, loss, corruption, or disclosure of uploaded information caused by events beyond reasonable control.

Bar Council Compliance

12.1This Website is not intended for advertising or solicitation within the meaning of applicable Bar Council of India Rules.

12.3By accessing the Website, the User acknowledges that:

The Firm reserves the right, without notice, to:

Indemnity

§ 15

Force Majeure

The Firm shall not be liable for failure or delay in performance caused by events beyond reasonable control including:

  • natural disasters,
  • governmental restrictions,
  • internet failures,
  • cyberattacks,
  • power outages,
  • strikes,
  • pandemics,
  • technical disruptions,
  • or server failures.
§ 16

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Courts at Bengaluru, Karnataka shall have exclusive jurisdiction to the exclusion of all other courts.

§ 17

Dispute Resolution and Arbitration

17.1The parties shall first attempt amicable resolution of disputes.
17.2Failing amicable resolution, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
17.3The arbitration:
  • shall be conducted by a sole arbitrator mutually appointed;
  • seat and venue shall be Bengaluru;
  • language shall be English.
17.4The arbitral award shall be final and binding on the parties.
§ 18

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
